Failed an Alcohol Test With a CDL? The Path Back

A DOT alcohol result of 0.04 or higher is a violation with the same door back as any other: the SAP process, finished properly.

Where am I? — free checker

A DOT alcohol test at 0.04 or higher is a Clearinghouse violation. (A result of 0.02–0.039 removes you from safety-sensitive duty for a set period but is not the same violation — check your record to see which one you actually have before you plan.) Prohibited status lasts until the SAP process is complete.

The one number that differs

Your return-to-duty alcohol test must come back under 0.02 (49 CFR 40.305) — and like every return-to-duty test it is directly observed and only counts after your SAP has made you eligible.

The way back is six steps

Designate a SAP → the evaluation → education or treatment → the follow-up evaluation and eligibility → the return-to-duty test → the follow-up testing years. Walk the whole path, or price it first on the costs page.

Included in the $49 ReturnToDuty Kit

  • Choosing a SAP: the price table ($399–$600 bundled is normal), the questions to ask before you designate, split-pricing and bait-pricing red flags, and the payment-plan truth
  • The no-job path in full: registering as an owner-operator in the Clearinghouse and designating a C/TPA for the test — what step services charge versus doing each piece yourself
  • The follow-up years: plan math (at least 6 tests in year one, up to 5 years), changing employers mid-plan, and what a new employer must do
  • Getting hired: the SAP-friendly carrier search method, what to say on an application and in an interview, and the consent forms — honestly, with no invented list of companies
  • Records and licenses: Clearinghouse consent, what employers actually see, the state downgrade defense timeline, and the cost tracker worksheet

Questions

What is my first move?

Run the free checker on this site to get your stage and next step, then choose and designate a SAP. FMCSA counted 210,007 drivers in prohibited status as of February 1, 2026, and 79.5% had not started — starting is the step that separates the drivers who come back from the count.

Can I drive a non-CDL job meanwhile?

Prohibited status bars safety-sensitive (CDL) work. Non-driving and non-CDL work is a different question — many drivers take it while they finish the process, and the SAP steps do not require you to be employed at all.
