Wrong record

If the record itself is wrong, don't do the SAP process for someone else's violation. Challenge the record.

Everything else on this site assumes the violation happened. This page is for the other case: the record is factually wrong — a test that was not yours, a refusal you were never ordered into, a result reported against the wrong driver. The legal fix exists, and it is not a Facebook 'clearing' service.

The two legal doors

Clearinghouse record correction

FMCSA's Clearinghouse has a process to dispute information in your own record: log in to your own account (never share the login), view the record, and submit a correction request with documentation — the employer's paperwork, the laboratory/MRO records, identity proof — showing the entry is wrong. Administrative errors (wrong dates, wrong driver, duplicates) are what this door is for.

DataQs

DataQs is FMCSA's system for challenging data in FMCSA records — the route for violations tied to inspections and roadside events, and the general 'the government's file on me is wrong' channel. File the challenge, attach the proof, and keep the case number.

What a challenge can and cannot do

It can remove or correct a record that is factually wrong. It cannot remove a violation that happened because the consequences feel unfair, the test was strict, or time has passed. Filing a challenge does not pause prohibited status while you wait — if driving again is urgent, drivers with a weak correction case are usually better served starting the SAP process in parallel than betting months on a challenge.

Never pay a 'record clearing' service. The documented scam pattern is a stranger taking $100–$350 by Zelle to 'flip' a record they cannot touch. The real correction doors above are free, they are yours, and they never ask for your password by message. See the scam shield.

Included in the $49 ReturnToDuty Kit

  • Choosing a SAP: the price table ($399–$600 bundled is normal), the questions to ask before you designate, split-pricing and bait-pricing red flags, and the payment-plan truth
  • The no-job path in full: registering as an owner-operator in the Clearinghouse and designating a C/TPA for the test — what step services charge versus doing each piece yourself
  • The follow-up years: plan math (at least 6 tests in year one, up to 5 years), changing employers mid-plan, and what a new employer must do
  • Getting hired: the SAP-friendly carrier search method, what to say on an application and in an interview, and the consent forms — honestly, with no invented list of companies
  • Records and licenses: Clearinghouse consent, what employers actually see, the state downgrade defense timeline, and the cost tracker worksheet
